Geriatric institutionalization and the right to liberty. Spain and Mexico

Abstract
In 2008, the United Nations Convention on the Rights of Persons with Disabilities entered into force in Spain and Mexico, a promoter country. Despite the Committee's recommendations, both states currently maintain legislation limiting their legal capacity and systems of substitution, while also maintaining procedures that allow for forced internment. The article analyzes the system of elderly care income in both legal systems after the entry into force of the Convention.
