Abstract

Labor is now considered a fundamental right. Our Constitution and other international legal instruments on the subject encompass the right to work for all Mexicans and/or all person in our national territory. However, there are few research about the grievances against workers at the service of the State, because it is a fact that workers as stipulated in article 123 constitutional, part A, have had more relevance in our legal systems, under which private sector workers have participated through the history of Mexico as one of the sectors that led the Mexican re­ volution. For that reason, it is appropriate to address that the fundamental rights of workers in the public service are often not respected, because labor laws providing bureaucrats workers have not been harmonized with international standards, despite the fact that Mexico is part of the International Labour Organization and it has signed several international treaties that are been incorporated into its legal system.

Licenciado en Derecho y candidato al grado de maestro en Derecho del trabajo por la Escuela Libre de Derecho; actualmente se encuentra cursando la especialidad en Administración y Procuración de Justicia en la Universidad Nacional Autónoma de México. Ha sido secretario particular de magistrado de circuito y actualmente es oficial administrativo en el Tercer Tribunal Colegiado en materia de Trabajo del Primer Circuito y profesor adjunto en la Escuela Libre de Derecho.
