Enforceability of economic, social and cultural rights

Abstract

The topic that will be developed in this project is how to make enforceable of economic, social and cultural rights. When we set out about them, we are talking about the rights to health, to housing, to an adequate standard of living, water and even to a healthy environment. The importance of these rights delimits my paper, because in most cases they have been required of the State through unstoppable social struggles, leaving aside the search for the legal solutions through the courts. In this sense, through this paper we will discuss the need to seek legal mechanisms enabling these rights holders to ensure their exercise as well as demand its recognition to the competent authorities, in order to set aside the fallacious argument about that social rights are simple desires away from the dogmatic law.
