Context Analysis. A Commitment to Justice in the Crime of Enforced Disappearance

Abstract

This article examines the utility of context analysis as a means of evidence in Mexico. It explores its dual function: as a tool for truth and memory, and as an active justice resource in the investigation of complex crimes—specifically in cases of enforced disappearances and those committed by individuals, which constitute serious human rights violations. To this end, the purposes of context analysis within Mexican legislation are examined to determine whether it possesses the status of a means of proof (legal evidence) in judicial proceedings. This framework is contrasted with the experience of Colombia, where this tool has been fundamental in clarifying and prosecuting crimes committed by macro-criminal networks within the context of the armed conflict. Finally, the article reflects on the potential of this resource in Mexico: a landscape of impunity and corruption where the operation of criminal structures results in grave human rights violations. grave human rights violations.
