Abstract
The objective of this article is to identify the state of compliance with the guarantee to provide medical, surgical, pharmacological and appliance treatments to trans and non-binary people when they request it in a conscious, free and informed manner. It also explains how and why the National Health System must guarantee them. In addition, the standard of protection of the human rights of trans and non-binary people is analyzed (related to gender identity and expression and other rights); as well as qualitative and quantitative information on these populations, the characteristics of the health system and the progress made in the matter in Latin America. Finally, a series of proposals are presented so that, to the extent medically and scientifically possible, their gender expression is a reaffirmation of their identity.
