Abstract

This work assesses the Supreme Court of Justice’s (SCJN) attribution to investigate gross human rights violations, as a unique constitutional tool in the region. To transfer this attribution to the National Human Rights Commission (CNDH), turned this special mechanism to ensure the right to the truth and the collective memory into a mere administrative procedure, with no social or legal impact whatsoever. Therefore, it must be given back to the Supreme Court of Justice.
