Restrictions on human rights in El Salvador during the COVID-19 pandemic

Abstract

The purpose of this article is to briefly address some preventive measures adopted by the Salvadoran Government because of the rapid spread of the coronavirus, likewise allusion is made to the restriction of fundamental and constitutional rights such as the right to free movement and the human rights violations that arose as a result of these restrictions, for example, the arbitrary detentions of anyone who did not keep the mandatory quarantine, in the same way, the right to work was also violated due to the unjustified dismissals due to the temporary closure of the companies and factories, which is related to other rights, such as access to water, food, cleaning supplies, adequate housing, among others, which derive from the right to a good quality of life. Also, I have related it to some criteria given by the Constitutional Chamber, the highest interpreter of the Constitution, about the measures that the State should take to avoid putting the human rights of the population at risk since there are human rights such as life, dignity, and integrity that cannot be suspended even during states of emergency.

Fany Ivannia Gómez Orellana

Estudios culminados en la Licenciatura en Ciencias Jurídicas de la Universidad Gerardo Barrios de El Salvador. Ha participado en varios concursos interuniversitarios e internacionales en materia de derechos humanos, obteniendo el reconocimiento al mejor memorial en la II Edición del Concurso Interuniversitario de Derechos Humanos, realizado en San Miguel, El Salvador. Asimismo, destaca su intervención como oradora en el XXIV Concurso Interamericano de Derechos Humanos, organizado por American University Washington College of Law.
