Abstract

This article analyzes the development and implementation of the concept of Restorative Justice in Colombia, focusing its study on its application and adoption by the Special Jurisdiction for Peace (SJP). The SJP is the justice component of the Comprehensive System for Truth, Justice, Reparation and Non-recurrence, created by the Final Agreement to End The Armed Conflict And Build A Stable And Lasting Peace, signed between the national government of Colombia and the Fuerzas Armadas Revolucionarias de Colombia on 26 November 2016. For this purpose, we provide an analysis of the different rules that regulate the use of restorative justice and that were issued to further the implementation of the SJP. The article follows a qualitative research of jurisprudence, doctrine and interviews. The description, classification, explanation and interpretation of data, provides an overview of the current situation and development of the concept of restorative justice within the SJP.

Abogado por la URosario, especialista en Derecho penal y en Derecho administrativo por la misma universidad. Especialista en Derecho penal por la Universidad de Salamanca (España), y magíster en Justicia Criminal por la Universidad Carlos III de Madrid (UC3M), España. Profesor de pregrado y posgrado en diferentes universidades y conferencista nacional e internacional. Se ha desempeñado como abogado litigante, asesor y consultor en derecho penal, disciplinario, responsabilidad fiscal y derecho administrativo. Ha sido tutor del Equipo de Técnicas de Juicio Oral de la URosario, investigador en derecho penal y secretario académico en la misma institución. Autor de diferentes textos jurídicos. Miembro del Consejo Directivo del Colegio de Abogados Rosaristas y socio de la Fundación Internacional de Ciencias Penales. Investigador junior reconocido por Colciencias-Convocatoria 781 de 2017.

William Javier Salazar Medina

Abogado de la Universidad Surcolombiana, especialista en Derecho probatorio por la Universidad Católica de Colombia y en Derecho administrativo y procedimiento administrativo por la Universidad Antonio Nariño, además de magíster en Derecho Penal por la Universidad Libre de Colombia. Doctorando en Derecho por la UC3M. Profesor de pregrado y posgrado en diferentes universidades y conferencista invitado. Exdecano de la Facultad de Derecho de la Universidad Antonio Nariño sede Neiva y exdirector de Consultorio Jurídico en la misma entidad. Autor de diferentes textos jurídicos.
