Abstract

This work addresses the nature of military checkpoints, following the presentation of the Bonfilio Rubio Villegas case before the Inter-American Commission on Human Rights, as a restriction on the freedom of movement, in light of national and international human rights standards in the matter, as well as the consequences that military checkpoints have on other rights. It is sustained that military checkpoints do not comply with the requirements of legality, necessity and proportionality that all restrictions on the freedom of movement must have.

Mecanismo Especial de Seguimiento para Nicaragua de la Comisión Interamericana de Derechos Humanos, Managua, Nicaragua.

Licenciado en Derecho por la Universidad Marista de Mérida (México) y maestro en Derecho Internacional de los Derechos Humanos (legum magister cum laude) por la Universidad de Notre Dame (Estados Unidos). Actualmente es especialista en terreno del Mecanismo Especial de Seguimiento para Nicaragua de la Comisión Interamericana de Derechos Humanos. Es autor de diversas publicaciones sobre derechos humanos en México y el extranjero.
